1. Agreement

By accessing getorderup.net or using any Order Up service, you agree to these Terms of Service. If you do not agree, do not use our services. These terms apply to all visitors, clients, and users of the Order Up platform.

Order Up provides restaurant website design, online ordering systems, payment processing integration, and related digital services to independent restaurants on a subscription basis. Specific deliverables are governed by your signed service agreement.

You may cancel your subscription at any time with 30 days written notice to hello@getorderup.net. No refunds are issued for partial months. Upon cancellation, your restaurant website will be taken offline at the end of the billing period.

6. Intellectual property

You retain ownership of all content you provide — your menu, photos, restaurant name, and logo. Order Up retains ownership of the website template, platform code, and ordering system infrastructure. You may not copy, resell, or repurpose the Order Up platform for any other business.

Order Up is not liable for lost revenue, lost orders, or business interruption caused by payment processor outages, hosting downtime, or third-party service failures beyond our reasonable control. Our total liability shall not exceed fees paid in the 30 days prior to the claim.

9. Disclaimer of warranties

Order Up is provided "as is." We do not guarantee that our platform will be uninterrupted, error-free, or that it will meet your specific business requirements. We do not guarantee any specific revenue increase or commission savings.

10. Governing law

These terms are governed by the laws of the State of Illinois. Disputes shall be resolved through binding arbitration in Cook County, Illinois before resorting to litigation.

11. Changes to these terms

We may update these terms at any time. Material changes will be communicated to active clients by email. Continued use of our services constitutes acceptance of the updated terms.
